Notice of Request for Redress & Protest Hearing 2 Oct 2010

Postby nbya » September 28th, 2010, 3:36 pm

NOTICE OF HEARING
NBYA SWANSON CUP

This is to notify that a hearing has been scheduled to hear the "redress" request of East Greenwich YC vs. the Barrington YC RC,
AND
the Part 2 protest of Cepheus Vs. Tonto

The hearing will be held on Saturday, October 2, at 4:30 PM at the New York Yacht Club, Harbour Court, Sailing Center, Jury Room, Newport, RI. This is to be heard in conjunction with the 2010 Etchells National Championship, which NYYC is hosting this weekend. There are 2 independent panels of highly qualified and neutral Judges in attendance.

With regard to the REDRESS hearing, in accordance with the (new, 1/2010) US Sailing prescription to rule 60, any boat that wishes to participate in this hearing as a "party" may submit a written request to the Protest Committee, which will accept those requests until 4:15PM, 10/2/10, 15 min before the scheduled hearing.

This posting of this message (on the NBYA website and notice board at host club Barrington YC) constitutes notice of the hearing in accordance with rule 63.2 and the US Sailing prescription to that rule. The nature of the redress hearing is that EGYC believes the BYC RC erred in the procedure for calculating the distance in the PHRF Team race at the recent Swanson Cup NBYA Regatta.
